1. Seller
These terms govern the sale of the products offered on the website kartcommerce.com by Mammola Francesco Paolo (sole proprietorship, KartCommerce brand), Via Vincenzo Acquaviva 23/C, 71121 Foggia (FG), Italy, VAT number IT04407020710, email info@kartcommerce.com (hereinafter "KartCommerce" or "the Seller"). The person responsible for sales is Francesco Paolo Mammola.
2. Scope
These terms apply to all orders placed on the website, whether by consumers (natural persons purchasing for purposes outside their trade, business or profession) or by professionals and businesses (teams, racing teams, workshops). The protections provided by the Italian Consumer Code (Legislative Decree 206/2005), such as the right of withdrawal and the 24-month legal guarantee of conformity, apply to consumers only. By submitting an order, the customer declares that they have read and accepted these terms in the version published at the time of the order.
3. Products
The features of the products are set out on their respective product pages. Images are for illustration purposes only; for spare parts, the item code (SKU), the selected variant and the compatibility stated in the description are binding. If in doubt about compatibility with their engine or chassis, the customer may contact us before purchasing. Products marked as "used" are sold in the condition described on the product page.
4. Prices
The applicable prices are those published on the website at the time of the order, expressed in euros. Shipping costs are calculated and shown at checkout before the order is confirmed. KartCommerce may change its prices at any time; changes do not apply to orders already submitted. In the event of an obvious pricing error, KartCommerce reserves the right to cancel the order and refund the full amount paid.
5. Orders and conclusion of the contract
An order is placed by adding the products to the cart, entering the shipping and payment details and confirming the purchase. After submitting the order, the customer receives an order summary email. The contract is deemed concluded when KartCommerce confirms the order. KartCommerce may refuse or cancel an order in the event of product unavailability, non-payment, incomplete details or suspected fraud, informing the customer and refunding any amount already paid.
6. Payment
The accepted payment methods are listed on the Payments page. The amount is charged at the time of the order. For each order, the tax document required by law is issued; customers with a VAT number who require an invoice can enter their details at checkout or write to info@kartcommerce.com.
7. Shipping and delivery
Shipping times, methods and costs are set out on the Shipping page. Delivery times are indicative and may vary for reasons beyond KartCommerce's control (for example courier delays or public holidays). On delivery, the customer must check that the parcel is intact and, if there is visible damage, accept it subject to inspection (with reservation), notifying the courier accordingly, and inform us within 48 hours, sending some photos.
8. Right of withdrawal
Consumers may withdraw from the contract within 14 days of receiving the products, without giving any reason, as described on the Returns & Right of Withdrawal page, which forms an integral part of these terms.
9. Warranty
The products are covered by the warranty described on the Warranty page: 2 years for consumers and 1 year for businesses and professionals, for new products.
10. Use of the products and liability
The products are intended for use on racing karts on authorised circuits. The customer is responsible for choosing a compatible product, for correct installation and for compliance with sporting regulations. KartCommerce is not liable for damage resulting from improper use, incorrect fitting, or modifications or maintenance not in accordance with the manufacturer's instructions, nor for indirect damage such as lost races or sporting results. This is without prejudice to any liability provided by law in cases where it cannot be excluded.
11. Personal data
Customer data is processed as set out in the Privacy Policy.
12. Governing law and jurisdiction
These terms are governed by Italian law. For disputes with professional or business customers, the Court of Foggia (FG), Italy has exclusive jurisdiction. For disputes with consumers, the court of the place of the consumer's residence or domicile has jurisdiction, as provided by the Italian Consumer Code; this is without prejudice to the mandatory provisions of the consumer's country of residence.
13. Changes
KartCommerce may update these terms. Orders are governed by the version published on the website at the time the order is submitted.
